The following Terms and Conditions apply to all purchases of products by you from Bahloo Ltd either via our website or our store

Welcome to the Bahloo website. Please take a moment to read our terms and conditions for use. These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions please do not use or access this Website. All products listed upon the website are done so as an Invitation to Treat.

ORDER. You can submit an order for products to bahloo.co.uk by completing the details on our order summary page and clicking the send order button. All prices are reflected in £UK pounds sterling and include V.A.T providing the delivery location is within the U.K. You may also order via our mail order service by calling 0151 353 0529.

ACCEPTANCE OF ORDER. We will notify you of our acceptance of your order by e/mail and you will also receive a call from one of our advisors. We will call regarding stock availability and to discuss delivery details. When the goods are despatched a binding agreement between us will be established. If we do not accept your order for any reason of the price of the product has increased between the time of order and our acceptance (or if a supplementary delivery charge applies) we will e-mail you to advise of the change. You will then have to resubmit your order. Only credit and debit cards are accepted as payment via this site. Gift vouchers and credit notes not accepted.

DELIVERY. Free delivery within five working days on all UK orders over £69.99 (subject to stock availability). Orders under £69.99 will be subject to a handling/shipping charge of £5.99 (subject to stock availability). One of our sales advisors will contact you by telephone or email with regards to advise you when your goods will arrive. If you wish to order from outside the UK please contact us for a delivery price PRIOR to placing the order.

Selected items may take longer to deliver but will be clearly marked on the product information page prior to ordering.

For furniture, selected changers and cot beds we use an outside transport company and goods may be delivered palletised and incurs a surcharge. For such deliveries please have help at hand at the delivery address as the driver may need assistance. As the driver is not employed by Bahloo, although he will deliver your goods into your home, he may not deliver orders into a specified room.

Delivery prices quoted are for UK mainland delivery only. For deliveries to Scottish Islands, Northern Ireland, Channel Islands, Isle of Man, Isle of Wight or Eire please call or email for details. If you are ordering from anywhere else in Europe please request a carriage price prior to buying.


If your goods do not arrive within five working days, e-mail or telephone us and we will contact the carrier. If you do not notify us, within 5 days we will not be able to trace your delivery.

All parcels we send are insured at no extra cost.

Would customers that have ordered furniture please note that the carrier asks if you could have someone to help the driver, as for insurance reasons they cannot guarantee that the driver will take the goods into the house.

Customers requiring delivery outside the UK should ask for a delivery quote before placing the order.         

SECURE PAYMENT. We will charge your account for payment at the time your order is placed.
The purchase area of our site is secure; this means that we use industry standard SSL technology to allow for the encryption of all sensitive information such as your name, address and especially your credit card details.

As of 1st March 2008 we are no longer able to accept personal or business cheques.

CARSEATS. Due to car seat specifications and safety we advise customers to install and check that the car seat is compatible and fits the intended car. If there are any problems the car seat should be returned in its original condition and packaging with in 7 days of purchase for a full refund

You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Registration
When registering toy use the site you agree to ensure:

The Personal Information which you are required to provide when you register as customer is true, accurate, current and complete in all respects; and that you will notify us immediately of any changes to the Personal Information by contacting us on 0151 353 0529 or via e-mail.

Privacy Policy
We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation.

When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, invoice address, telephone number, product selections, credit card or other payment information.

We confirm that any Personal Information which you provide to us and any User Information from which we can identify you, is held in accordance with the Data Protection Act. We use your information only for the following purposes:

  • Processing your orders

  • For statistical purposes to improve our website and its services

  • To administer this website;

  • To notify you of products or special offers that may be of interest to you, with your consent.

You agree that you do not object to us contacting you for any of the above purposes whether by telephone, e-mail or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.

Bahloo Rights

We reserve the right to:

Change without notice any prices/product descriptions without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

Change the Conditions from time to time. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

Contract Creation and Electronic Contracting
The technical steps required to create the contract between you and us are as follows:

You place the order for your items on the web-site by pressing the order confirmation button at the end of the check-out process and making your payment.

We will send to you an automatic order acknowledgement email detailing the products you have ordered. This is not an acceptance of your order, it is an automated confirmation.

Acceptance of order
The contract in respect of the products supplied by us to you comes into existence when your order has been accepted by us i.e. the goods have been despatch to you. For the avoidance of doubt, receipt of an order via our Site does not constitute acceptance of an order.

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being out of stock/discontinued.

  • The inability to obtain authorisation for your payment.

  • The identification of a pricing or product description error.

Product descriptions & Photographs
We reserve the right to alter specifications/descriptions without prior notice. All sizes and weights given as a guide only and are approximate. Representations of colour are approximate due to the limitations of photography and computer graphics. A name given to a product is not necessarily representative of the colour. All goods are subject to availability. If sold out, free offers may be substituted with an item of the same value.  Wood is a natural product and the grain or shade will vary form piece to piece. This does not constitute a fault.

Special Offers

Where goods are offered at a "Special offer" price, items are allocated on a first come first served basis and we are not obliged to provide an alternative at the offer price should stocks run out. Items on Special Offer cannot be bought in conjunction with any other offer. This includes 10% Twins discount.

The Agreement

Our agreement will be governed by English law and any disputes will be resolved exclusively by English Courts

Payment
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. We reserve the right to change prices without notice.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

All card payments are processed for you by HSBC Global Payments.

Refusal of Transaction
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.


Your right To Cancel 

If you wish to cancel your order, goods may be returned to Bahloo Ltd, Unit 14 Burton Nurseries, When returning products by post, please ensure you package and label them properly so that they are not lost or damaged in transit. For insurance purposes please retain proof of postage


You have the right to cancel your order with us at any time before the expiry of 7 days from the day after the date of delivery.

Please note that if your order has been processed we are unable to cancel it and therefore return costs are at your expense.

If the delivery address refuses delivery of the goods or if you do not respond to the "sorry we missed you" card left by your driver, your order will be returned to the sender (Bahloo Ltd) and you will be charged for the return of the order.  Please note Parcel Force returns charges: £23.00 up to 30kgs


Wrong Delivery Address Inputted
If you provide us with a wrong delivery address and your goods are signed for by another party, we cannot be held responsible for loss or damage to your goods.

Refunds & Exchanges

We will be happy to exchange any item(s) that you are not completely satisfied with, as long as they are returned in an unused condition, within 7 days and with proof of purchase. However, we will not offer a refund or exchange where you have changed your mind about wanting the goods. This does not affect your statutory rights. Please note any postage incurred by returning the item(s) to us will not be refunded.

Products that are damaged or faulty will be repaired or replaced but we will not offer a refund or exchange where items have been misused. In the event of a dispute, items will be returned to the manufacturer for verification prior to the issue of a refund. All items must be used in accordance with the manufacturers instructions provided.


Product Guarantee
All items purchased from Bahloo are covered by a 6 month guarantee.  We will exchange or repair any product if it displays a manufacturing fault within 28 days.  If it displays a manufacturing fault after 28 days but within the guarantee period we will repair or send spare parts to you free of charge. Loan buggies may be available free of charge to collect from our store in Burton*.


Accidental damage and damaged caused by misuse is not covered by this guarantee and therefore a charge will be made. If you have damaged any of your nursery items you may be able to make a claim against your household contents insurance.
This warranty does not affect your statutory rights

If Accidental damage, misuse or general wear & tear occurs within 6 months this is not covered under your guarantee and a £25.00 admin handling charge plus any repair charges will apply.

6-12mths: Accidental damage, misuse or general wear & tear are not covered and a £40.00 administration & handling charge will apply

Admin handling charges will be charged after inspection to the paying card of the original order; if the goods are suffering from Accidental damage, misuse or general wear & tear. We will then return the goods to the address from where the collection was made.

All products which require repair outside their guarantee period will be quoted for individually.

*Free of charge only applies when the loan buggy is being collected and returned to the store in Burton, a non refundable charge of £40.00 applies for home delivery of a loan buggy. Loans are subject to availability and may a different make / type and specification to your original purchase. We do not provide a “like for like” loan service.

Manufacturing Faults

If a product you have purchased from us develops a manufacturing fault during the warranty period we will arrange for a free of charge repair to be carried out. In some cases we may have to establish if the problem you are experiencing is caused by a manufacturing fault. In such cases we may ask you to contact the manufacturer, many manufacturers provide a customer help line and can often rectify the problem over the telephone.

When a manufacturing fault occurs the product is returned to the manufacturer for inspection or repair, if this happens please allow up to 6 weeks for the return to be made. Please note that a replacement product will be provided only if repair is impossible or not viable. In cases of customer misuse or general wear and tear, it may be possible for us to arrange a repair however in these circumstances an administration, handling and returns fee will apply, you will be informed of this prior to any arrangements being made.

Goods outside the Manufacturers Guarantee Period
If outside the manufacturers guarantee period your wheeled or nursery goods require repair, Bahloo will have or obtain the necessary parts to repair your product to a usable condition. If we cannot supply you with fabric as it has been discontinued, we will endeavour to find a suitable match for your pram, pushchair, stroller, or travel system and reserve the right to offer an alternative fabric option.

Due to the nature of some repairs it may be necessary for your product to be returned to the manufacturer.  Where this is deemed necessary a repair quotation will be given and payment requested before the repair is carried out

Delivery dates

We will not be liable to you for any breach of our agreement, for delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, floods, drought, fire, legislation or other cause beyond our reasonable control. This does not affect your statutory rights. During busy periods for certain brands, pram lead times can be up to four months and we ask that you bear this in mind when placing your order.

Payment terms

Payment must be made in full prior to the goods being released from our premises. We accept all major credit and debit cards. Goods remain the property of Bahloo Ltd until they are paid for in full.


Privacy

We take your privacy seriously and will treat all of your personal information in accordance with all applicable data protection laws in the UK.. Bahloo Ltd will not sell, transfer or give freely your personal information to any company or organization without your consent except to comply with laws or regulations of the government or other regulatory body, or to protect the rights of the Bahloo Ltd.
